All content, features, and functionality of HabbitArc, including but not limited to text, graphics, logos, icons, images, audio, software, and the overall design, are owned by HabbitArc and are protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.
You retain ownership of any content you submit through the App (such as meal photos, journal entries, and profile information). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and display such content solely for the purpose of providing and improving our services.
The App may integrate with third-party services such as Apple HealthKit and social platforms. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HABBITARC AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
You agree to indemnify and hold harmless HabbitArc and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.
We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease.
You may terminate your account at any time by deleting your account through the App or contacting our support team.
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last Updated" date. Your continued use of the App after such changes constitutes acceptance of the modified Terms.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through informal negotiation. If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and HabbitArc regarding your use of the App and supersede any prior agreements.
